A point Lessig makes particularly well (I went to his RSA lecture a few months back) is that this confusion about free is due to very recent change in how humans use ideas. Until the last century this discussion would have been unthinkable because to understand the need for content to be free you need to conceive of it being locked up, something pretty unthinkable before the 19th and 20th centuries.
